Author's Note
Earlier this year, the Ontario government amended the Employment Standards Act ("ESA") to require non-Crown, provincially regulated employers who employed 25 or more employees as of January 1, 2022 to develop and distribute a policy dealing with the electronic monitoring of all Ontario based employees employed by the employer. For employers with the requisite number of Ontario employees, this policy must be developed by October 11, 2022. To help organizations navigate these changes, members of Gowling WLG’s Employment, Labour & Equalities Group are pleased to offer a sample electronic monitoring policy that employers can use as a foundation for their own policies. This sample policy is accompanied by a checklist that sets out further details regarding the statutory requirements, in addition to other considerations, with a view to helping employers ensure that their policies comply with the law and meet the unique needs of their organizations.
