Does an exception of the registration duty exist?
Art. 31 FinSO stipulates an exemption from the registration duty according to which, client advisors of foreign financial service providers which are prudentially supervised abroad are exempted from the duty to register if the services they provide in Switzerland are exclusively for professional or institutional clients.
What are the requirements for registration?
Art. 29 FinSA lays down the individual requirements under which a client advisor is entered in the register of advisors. Thus, client advisors are entered in the register of advisors if they prove that they
- possess the knowledge and expertise required according to 6 FinSA,
- have taken out professional indemnity insurance or that equivalent collateral exists and
- are affiliated to an ombudsman's office in accordance with art. 74 FinSA.
Thereby, the last two conditions are deemed fulfilled if they are met by the financial service provider for which the client advisors are working for.
However, client advisors shall not be entered in the register of advisors if they
- have been convicted of criminal offences in accordance with art. 89 to 92 FinSA (i.e. violation of the code of conduct, violation of the regulations on prospectuses and key information documents and unauthorized offering of financial instruments) or of property offences under art. 137 to 172ter of the Swiss Criminal Code or
- have been prohibited from performing the registrable activity in accordance with art. 33a FINMASA or from practicing a profession in accordance with art. 33 FINMASA.
