Did the scope of financial products change from the oldCISA to the revCISA?
Before the coming into force of the FinSA, the oldCISA regulated collective investment schemes (cf. art. 7 et seqq. oldCISA) and structured products (art. 5 oldCISA). Structured products now have been moved from the CISA to the FinSA (cf. art. 70 et seq. FinSA) and collective investment schemes have remained in scope of the revCISA.

Are distributors still subject to license requirements?
Under art. 13(2)(g) oldCISA, distributors were subject to a license requirement. With the introduction of the FinSA and the repeal of the distribution concept, this requirement has been removed from the CISA but not incorporated into the FinIA (for more information on the repeal of the distribution concept, please consult the topic Distribution vs. Offer). Hence, distributors no longer require a license by the FINMA. The FINMA has notified all distributors regarding the repeal of the license requirements and made them aware that their license are no longer valid as of 1 January 2021. However, in case the distributor provides a financial service and acts as a client advisor, such distributor must comply with the code of conduct rules set forth in the FinSA and register as a client advisor.
