How shall a financial service provider inform about the possibility to opt-in?

According to art. 5(7) FinSA financial service providers shall inform those of their clients who are not classified as retail clients of the possibility to opt-in, before providing any financial services.

This information may e.g. be provided by means of a letter, an appendix to the to be concluded service agreement or by e-mail.

How does the financial service provider have to inform clients about the general risks of financial instruments?

Art. 8(1)(d) FinSA requires that clients shall be informed about the general risks associated with financial instruments.

Due to this requirement, the Swiss Bankers Association (SBA) has issued the risk brochure “Risks involved in Trading Financial Instruments”, replacing the previous brochure “Special Risks in Securities Trading”. The new risk brochure explains the general and special risks associated with financial instruments and contains general information on typical financial services in the investment field.

This risk brochure can be used by all financial service providers for the purpose of informing about the general risks of financial instruments. The brochure can either be provided physically or electronically or it can be published on the financial service provider’s homepage. The client or other recipients of the risk information (e.g. the power of attorney holder, the legal representative) have the possibility to waive the receipt of the brochure if they confirm that they have taken note of the content online.
