Do documents produced before 1 January 2020 need to be delivered to the client?

Yes, if the documents in scope are still available in the archiving systems. In general, the scope of documents shall be determined at the time of the client’s request, regardless of when the document was produced. This will also apply to art. 18 FinSO after the FinSA go-live of the respective financial service provider.

What does not have to be provided to the client?

  • Purely internal documents:
    Purely internal documents are documents that are not produced in the sense of art. 15 and art. 16(2) FinSA. These documents are not considered to help the client to assess whether the financial service provider has acted in accordance with the contract or the law. In particular, such documents are the following: 
    • preparatory studies
    • contract drafts
    • notes/memos with no obvious connection to the client's case
    • etc.
  • The documentation with the ombudsman's office:
    According to art. 75(3) FinSA, the correspondence of the financial service provider with the ombudsman's office does not need to be provided to the client.
