If a PIV is classified as a retail client, is there a possibility to opt-out to be treated as a professional client?

If the PIV has been set up for a high-net-worth retail client and does not have professional treasury operations, the PIV can request to change its client segment to professional client acc. to art. 5(1) and (2) FinSA. The declaration can only be made by the representative of the PIV.

Can a PIV with a professional treasury also be classified as a company with a professional treasury?

No. The term "company" as understood under art. 4(3)(g) FinSA encompasses i.a. commercial enterprises (kaufmännische Unternehmen), i.e. a trading, manufacturing or other type of commercial business as under the general description of art. 934(1) CO (please also refer to the definition of the term company under the topic CISA vs. FinSA). Such companies need to be distinguished from PIVs, e.g. domiciliary companies (c.f. question 1.).
