The Ombudsman Requirements of the FinSA

Do the FinSA and the FinIA distinguish between two different ombudsman’s offices?

No. Art. 77 FinSA (for financial service providers) as well as art. 16 FinIA (for financial institutions) stipulate a duty to affiliate with an ombudsman’s office at the latest on commencing activity. Same as the old art. 16(2) FinIA,  the revised art. 16 FinSA refers to Title 5 of the FinSA (Ombudsman’s Offices) for an analogous applicability of these provisions to financial institutions.   However, the legislative materials do not provide any information on what is meant by applying the aforementioned FinSA provisions by analogy. 

Hence, the term “financial service provider” in Title 5 of the FinSA can be understood as “financial institution” as defined under the FinIA. Also in practice, the already recognized ombudsman’s offices do not distinguish between financial service providers and financial institutions (see e.g. Ombudsman Financial Service Providers [OFD]). 

Is a financial service provider/financial institution obliged to participate at a mediation proceeding initiated by the client?

Yes, if the client initiates a mediation proceeding, the financial service provider/financial institution is obliged to participate according to art. 78(1) FinSA. However, there is no duty for the client according to the FinSA in the opposite case, i.e. if a financial service provider/financial institution initiates a conciliation proceeding.
