Do financial institutions who already have a license need to obtain a new license? 

Financial institutions who already have a license based on art. 1(1) Financial Market Supervision Act (FINMASA) are not required to obtain a new license, but they have to comply with the FinIA obligations within one year of its coming into force (art. 74(1) FinIA), i.e. until 1 January 2021.

Can existing financial institutions who were not subject to any license requirement under prior law continue with their business?

They may continue their business to the extent that they have notified the FINMA within the six month period (c.f. question 5.2.) and are affiliated with a self-regulatory organization (SRO) in accordance with the Anti-Money Laundering Act (AMLA) until the FINMA decides on the license application (art. 74(2) FinIA). This also includes the use of the term “portfolio manager” and “trustee”.
